Initiating legal proceedings in Turkey is facilitated by the fact that no Court Ruling is needed to enforce a claim. The first step of the legal procedure is the filing of your case at the Enforcement and Execution Office. The Bailiff will then issue an official payment order to the debtor, to which the latter has 7 days to object. If no official objection is received the Bailiff can proceed for attachment of debtor assets immediately after.

Filling out the POA

In Turkey, the filing of a debt claim at the Bailiff (Enforcement Office) can only be executed by a lawyer (Bar Member) who needs a Power of Attorney (PoA) filled out by the creditor in order to initiate proceedings. The PoA is an official legal document required to assign a lawyer for legal representation. The Turkish judicial authorities are extremely strict before accepting the document. Any small mistake will result in rejection of the PoA. Therefore please carefully read our underneath instructions.

1. Please first†download the empty†POWER OF ATTORNEY

2. Fill out the relevant information according to the hints between brackets, and delete the latter. Please be noted that on the Turkish†(right)†side, the \'Creditor Country of Origin\', should be filled out in Turkish. Take a careful look at the†EXAMPLE POA. 3. Sign the document at the bottom by your signature and full name.

4. The PoA in itself does not suffice to let our lawyer commence representation.†The creditor company needs to fill out a short informatio form which will oficially notify our lawyer for which acitivity she will be assigned. Please do not forget to attach the filled out PoA for verification by us.

5. Legalization of the PoA: After you have received our approval, you should let the document be legalised by the competent authority in the country of the creditor. This is often the ministry of exterior or an overarching diplomatic service attached to it. The majority of all developed industrial economies are signatory to the Hague Convention (1961), which implies PoA\'s stemming from these countries only need an APOSTILLE (click for more info). 6. The document should then finally be sent by international courier to the following address:

Financial Details:

Filing a debt claim at the Enforcement and Execution Office in Istanbul takes 0.5 % of the total claim including calculated interest, plus official notification expense of $100 + $10. The administration fee is EUR 74.50. Upon succesful collection in this phase, please take into account that the lawyer first deducts its attorney fees †(varying between 10-15%) from the total recovered amount.
